Wyrok kontrolowanego przez władzę Trybunału Konstytucyjnego wydany na wniosek premiera Mateusza Morawieckiego otwiera kolejny etap politycznej i prawnej konfrontacji między Polskim rządem a Unią Europejską. Zanegowanie zasady pierwszeństwa prawa europejskiego nad krajowym oraz odmowa uznania wyroków Trybunału Sprawiedliwości w odniesieniu do zasady niezależności sądownictwa, w sposób otwarty podważa główne zasady porządku prawnego UE. Werdykt postawił również pod znakiem zapytania dalszą formułę uczestnictwa Polski w integracji europejskiej.

Podczas debaty zastanowiliśmy się, jakie są konsekwencje orzeczenia TK dla Polski i Unii Europejskiej oraz czy rzeczywiście – jak głosi rozpowszechniona opinia – Polska weszła na drogę polexitu. Przedyskutowaliśmy również, w jaki sposób Unia Europejska powinna bronić swojej przestrzeni prawnej oraz autorytetu TSUE.

The ruling of the government-controlled Constitutional Tribunal, issued at the request of the Prime Minister Mateusz Morawiecki, opens the next stage of the political and legal confrontation between the Polish government and the European Union. By questioning the primacy of European law and refusing to recognize the judgments of the EU Court of Justice with regard to the principle of the independence of the judiciary, Poland challenged the fundaments of the EU legal order. The verdict has also opened speculation as to whether the PiS-led government wishes Poland to remain a member of the EU for much longer.

During the debate we will discuss what are the consequences of judgment for Poland and for the European Union. We will ask experts whether Poland has actually entered the path of polexit and what the EU should do to defend its legal space and protect the authority of the CJEU.
